Monica Fiorella Jewelry is a sole proprietorship owned and operated by Monica Fiorella Yichoy, doing business as Monica Fiorella Jewelry, registered in the State of California.
These Terms & Conditions govern the use of:

“Services” refer to the sale of handcrafted jewelry, custom design services, and related content provided through the Site.

If you do not agree with these Terms, please do not use the Site or purchase our products.
3. PRODUCT NATURE & ARTISTIC VARIATION
All jewelry is handcrafted in small batches or created as one-of-a-kind pieces.
Due to the handmade and sculptural nature of the work:
Slight variations in form, texture, finish, or dimension may occur.
Measurements are approximate.
Colors may vary depending on device screens.
Certain pieces may include fine or delicate metalwork.
These characteristics are inherent to handcrafted art jewelry and are not considered defects.
4. PRICING & PAYMENT
All prices are listed in U.S. dollars (USD).
Payments are processed securely through Squarespace-supported payment processors. Monica Fiorella Jewelry does not store full payment information.
We reserve the right to correct pricing errors or inaccuracies at any time.
5. CHARGEBACKS & PAYMENT DISPUTES
Customers agree to contact Monica Fiorella Jewelry directly to resolve any concerns prior to initiating a chargeback or payment dispute.
Fraudulent or abusive chargebacks may be contested and pursued to the fullest extent permitted by law.
6. CUSTOM & MADE-TO-ORDER WORK
Custom, personalized, and made-to-order pieces are final sale and not eligible for return or exchange.
A 50% non-refundable deposit is required before any custom work begins. Once the deposit is received, the order will be scheduled and processed.
The remaining 50% balance must be paid in full prior to shipment. Custom orders will not be shipped until full payment has been received.
Once production has commenced, orders may not be canceled.
Any changes requested after design approval may incur additional fees and may extend production timelines.
7. SHIPPING
All orders are shipped via USPS with tracking.
Processing times vary and are communicated at checkout or via confirmation email.
High-Value Orders
Orders above a value determined by Monica Fiorella Jewelry may require signature confirmation and additional insurance.
Risk of Loss
Risk of loss transfers to the buyer upon confirmed delivery by the carrier.
Monica Fiorella Jewelry is not responsible for carrier delays, loss, theft after confirmed delivery, or shipping disruptions beyond our reasonable control.
If a package arrives visibly damaged, you must notify us within 48 hours of delivery and provide photographs of both packaging and item.
8. RETURNS (NON-CUSTOM ITEMS)
Eligible non-custom items may be returned under the following conditions:
Return request must be made within 14 calendar days of confirmed delivery.
Item must be unworn, unused, and in original condition.
Item must be returned in original packaging.
Buyer is responsible for return shipping costs.
Original shipping charges are non-refundable.
Returns must be shipped with tracking. Buyer assumes responsibility until the item is received and inspected.
Refunds are issued to the original payment method within 3–7 business days after inspection and approval.
Credit card fees are not refundable.
We reserve the right to refuse returns that show signs of wear, alteration, misuse, or damage.
9. NON-RETURNABLE ITEMS
The following items are final sale:
Custom or personalized pieces
Made-to-order items
Items altered by third parties
Items damaged due to misuse or improper care
10. CANCELLATIONS
Cancellation requests must be made within 24 hours of placing the order. To guarantee that your order has been canceled, you will need to receive a confirmation email from us.
Once an order has shipped, it may not be canceled.
After 24 hours of placing an order, cancellations are no longer permitted. The customer may instead request a return in accordance with the Returns policy above.
11. JEWELRY CARE & ASSUMPTION OF RISK
Certain pieces may include fine metalwork, sculptural elements, or delicate structures. These characteristics are part of the artistic design and require mindful wear.
To preserve the integrity of your jewelry, avoid:
Exposure to saltwater, chlorinated pools, hot tubs, or saunas
Contact with household cleaners, chemicals, or abrasive substances
Gardening or activities involving soil or abrasion
Exercise, swimming, diving, or strenuous physical activity while wearing jewelry
Sleeping while wearing delicate pieces
Physical impact, pulling, cutting, compression, bending, twisting, or crushing
Applying perfume, hair spray, lotions, or cosmetics directly onto jewelry
Natural tarnishing of sterling silver is expected over time and is not considered a defect.
Jewelry is not indestructible. Damage resulting from normal wear over time, impact, environmental exposure, improper storage, excessive force, alteration, or other misuse — whether specifically listed above or not — is not considered a manufacturing defect.
By purchasing and wearing our jewelry, you acknowledge responsibility for proper care and handling.
Monica Fiorella Jewelry is not responsible for damage resulting from misuse, improper care, environmental exposure, alteration by third parties, or for allergic reactions, skin sensitivities, or other medical conditions related to the wearing or handling of jewelry.
12. USER CONDUCT & PROHIBITED ACTIONS
User Conduct
By using this Site, you agree not to:
Use the Site for any unlawful purpose.
Attempt to gain unauthorized access to any portion of the Site.
Interfere with or disrupt the Site’s security or functionality.
Transmit malware, viruses, or harmful code.
Use automated systems (including bots or scraping tools) to extract data.

Designs may not be copied, reproduced, cast, modified, reverse-engineered, distributed, or commercially exploited without written permission.
Purchase of a piece does not transfer reproduction rights.

In all circumstances, the total liability of Monica Fiorella Jewelry shall not exceed the amount actually paid for the item giving rise to the claim.
17. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Monica Fiorella Jewelry and its owner, Monica Fiorella Yichoy from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of misuse of products, violation of these Terms, or use of the Site.

We are not liable for delays or failure to perform resulting from events beyond our reasonable control, including but not limited to natural disasters, carrier disruptions, governmental actions, illness, power outages, or supply shortages.
19. INTERNATIONAL DUTIES & TAXES
For orders shipped outside the United States (international orders):
The buyer is responsible for any customs duties, import taxes, VAT, brokerage fees, or other charges imposed by the destination country.
Monica Fiorella Jewelry does not control and cannot predict these charges.
Refusal to pay customs fees does not qualify as grounds for return.
International shipping times may vary due to customs processing beyond our control.
Applicable U.S. sales taxes, if any, are calculated at checkout and are separate from international customs duties or import charges.
20. GOVERNING LAW & VENUE
These Terms & Conditions are governed by the laws of the State of California.
Any disputes shall be resolved exclusively in the courts located in Solano County, California.
21. CHANGES TO TERMS
We reserve the right to update or modify these Terms at any time. Changes take effect upon posting to the Site.
